Interaction with Director – No Concrete Resolution Protest via Candle March Follows

Due to the breakdown of negotiations with the Director on day 24th of the demonstration, NIPER’s non-teaching staff under banner of NSWA demonstrated protest via Candle March, on 25th September 2026. Now the families including children of the employees have joined the Candle March

An interaction with non-teaching employees had been scheduled by NIPER Director, on 24th September 2026 and the same was attended by all concerned employees. The Director stated—that ministry approval is required to restore the Personal Pay Scheme (PPS) kept in abeyance by him only since 2020. During the meeting, the Director stated that this is not in his capacity as Director and Chairman of the Board of Governors (BoG), he possesses no authority in the matter. He explained that any decision would be taken solely by the Ministry; his hands are tied, and he is unable to make any administrative decisions.

The association members emphasized that this recent assertion contradicts both statutory framework and historical institutional precedence. In accordance with governing Act of NIPER, decisions regarding policies previously sanctioned by the BoG, fall under the purview of the “Director” Only.

The Board of Governors (BoG) the Supreme Body of an Autonomous Institute (NIPER) is policy making Authority, under Statutory Mandate: Under Section 8 of the NIPER Act, 1998 and Clause 3.1.2(a) of the NIPER Statutes, 2003. In Previous years (of 2003/2008/2013) introduced structured and approved ,Personal Pay Scheme (PPS) 1st meeting was scheduled & approved in 40th BoG Meeting on November 27, 2003, and subsequently revised and approved with effect from September 1, 2008, at the 59th BoG Meeting on March 23, 2013.The same was awarded to all non-teaching employees since 2003 to 2020.

During the interaction with Director, the association members highlighted that as per NIPER Act & Statue, for previous decisions, ministry has no role to hold the BoG’s approved policies and decisions. The association highlighted that it is the duty of Director only, to implement the decisions of the Board of Governors. As per the constitution of the BoG( in year 2003/2008/2013), under section, consequently members from the Ministry actively participated and attended these three meetings and deliberately the PPS was awarded, So, again and again, asking to ministry for grant approved PPS is totally illogical ,irrational and irrelevant at this stage.

And even During the 1st Council meeting( for all 7 NIPERs) on 28.02.2023, MoM 7(iv) With the amendment of the Act, the powers of the Board have not been taken away, but the Council has been given advisory role.

For all 7 NIPERs in the nation, the Council, constituted vide Government of India, Ministry of Chemicals and Fertilizers, Department of Pharmaceuticals Order No. 50013/2/2022-NIPER (E-20049), dated the 26th September 2022 only And nowhere it’s mentioned that its decisions will be implemented retrospectively.

NSWA respectfully appeal to the Hon’ble Minister of Chemicals and Fertilizers, Shri J. P. Nadda Ji, and the concerned authorities request that this PPS duly approved by BoG to Non-Teaching Employees may be continued as the CAS to the Teaching Staff of the NIPER Mohali , till the time another policy is extended to all 7 NIPERs by NIPER Council, to look into this long-pending issue and ensure a fair and just resolution for the non-teaching employees of NIPER.
